释义	假想防卫是指行为人由于主观认识上的错误，误认为有不法侵害的存在，实施防卫行为结果造成损害的行为。对于假想防卫，应当根据认识错误的原理予以处理，有过失的以过失论，无过失的以意外事件论。【法律依据】《刑法》第十四条，明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
