法律分析：旅行社在出发前7日以内解除合同的，要向旅游者退还全额费用，并支付违约金。出发前7日至4日，违约金为旅行费用总额的10%;出发前3日至1日为15%;出发当日为20%。若旅客在出发前7日至4日解除合同，违约金为旅行费用总额的50%;出发前3日至1日为60%;出发当日为80%。
法律依据：《中华人民共和国民法典》 第五百八十八条 当事人既约定违约金，又约定定金的，一方违约时，对方可以选择适用违约金或者定金条款。
定金不足以弥补一方违约造成的损失的，对方可以请求赔偿超过定金数额的损失。
