释义	法律分析：土地使用者需要继续使用土地的，应当迟于届满前一年申请续期，根据社会公共利益需要收回该土地的，应当予以批准。准予续期的，应重新签订土地使用权出让合同，依照规定支付土地使用权出让金。土地使用权使用年限届满，土地使用者未申请续期或未获批准的，土地使用权由国家无偿收回。法律依据：《中华人民共和国城镇国有土地使用权出让和转让暂行条例》第四十一条土地使用权期满，土地使用者可以申请续期。需要续期的，应当依照本条例第二章的规定重新签订合同，支付土地使用权出让金，并办理登记。
