问题	什么是移送管辖与应诉管辖
释义	根据《刑事诉讼法》第36条规定，人民法院发现受理的案件不属于本法院管辖的，应当移送给有管辖权的人民法院，受移送的人民法院应当受理。受移送的人民法院认为受移送的案件依照规定不属于该院管辖的，应当报请上级人民法院指定管辖，不得再自行移送。应诉管辖，指本不具有该案管辖权的法院，由于当事人放弃管辖权异议或者超过管辖权异议的提出时限而应诉，人民法院有权对该案进行审理。
