释义	法律分析：在国外申请的专利，如果不是国际专利，且没有在国内申请专利，则不受保护。因为专利本身具有地域性，专利权的取得要经过申请，经一国专利行政部门的授予后，才在该国所管辖区域内享有垄断的权利，因此，就会存在中国专利、美国专利。法律依据：《中华人民共和国专利法》第三十六条发明专利已经在外国提出过申请的，国务院专利行政部门可以要求申请人在指定期限内提交该国为审查其申请进行检索的资料或者审查结果的资料；无正当理由逾期不提交的，该申请即被视为撤回。
