释义	法律分析：法律并没有规定劳务作业分包需要经工程建设单位认可。除当事人另有特别约定外，劳务作业分包合同无须经过发包人的同意。法律依据：《房屋建筑和市政基础设施工程施工分包管理办法》第九条　专业工程分包除在施工总承包合同中有约定外,必须经建设单位认可。专业分包工程承包人必须自行完成所承包的工程。劳务作业分包由劳务作业发包人与劳务作业承包人通过劳务合同约定。劳务作业承包人必须自行完成所承包的任务。
