房产买卖合同未签成责任谁承担

法律分析：
房产买卖合同未签成责任一般由主动违约的一方承担；如因不可抗力或国家政策影响，则双方互不追责；如因双方就房屋交易本身始终不能协商一致而未签成合同，双方都不需承担责任。
法律依据：
《中华人民共和国民法典》第五百六十二条
当事人协商一致，可以解除合同。当事人可以约定一方解除合同的事由。解除合同的事由发生时，解除权人可以解除合同。
