释义	法律分析：不仅是可以，而且是应当作为依据，最高人民法院的批复属于司法解释，对法院的工作具有指导作用。在一个案件的审理过程中，如果本案的事实已被人民法院发生法律效力的裁判所确认，可以直接作为证据使用而无需举证证明了，但是，对方当事人有相反证据足以推翻该生效判决的除外。法律依据：《中华人民共和国民事诉讼法》第九十九条调解未达成协议或者调解书送达前一方反悔的，人民法院应当及时判决。
