释义	法律分析：如果不是刑事公诉案件报案之后当事人可以撤案。如果是人民检察院对犯罪源嫌疑人的犯罪行为向人民法院提出控告的这一类的公诉案件，则不可以撤案，只有公安机关认为情节显著轻微、危害不大，不认为是犯罪的；批捕阶段检察机关作出不批捕的决定的；或者检察机关作出不起诉决定的，可以由公安机关撤案。法律依据：《刑事诉讼法》第一百六十三条在侦查过程中，发现不应对犯罪嫌疑人追究刑事责任的，应当撤销案件；犯罪嫌疑人已被逮捕的，应当立即释放，发给释放证明，并且通知原批准逮捕的人民检察院。
