释义	法律分析：可以办理河道采砂证，办理了采砂证以后，能从事河道采砂活动。凡是以清淤名义进行非法采砂活动的，水利部门都要严肃查处。但如果河道淤积确实严重，影响行洪，可以按程序提出清淤申请，水利部门将根据实际情况进行统一规划，制定科学的清淤方案。法律依据；《中华人民共和国水法》第三十九条国家实行河道采砂许可制度。河道采砂许可制度实施办法，由国务院规定。在河道管理范围内采砂，影响河势稳定或者危及堤防安全的，有关县级以上人民政府水行政主管部门应当划定禁采区和规定禁采期，并予以公告。
