公司架构调整要求转岗合法吗

法律主观：
1、公司要求职工转岗，职工不同意是合法的。单位调动工作岗位的需要与职工一致协商签订 变更劳动合同 书，职工不同意变更的，不能以此为由将职工辞退。 2、如果存在 不能胜任工作 ，则公司有权调整工作岗位或者进行培训，如果仍然不能胜任工作，公司有权 解除劳动合同 ，但应根据法律规定提前一个月通知并 支付经济补偿金 。
