释义	律师分析: 证约定金，是指以交付事实作为当事人之间存在合同关系的证明的定金。证约定金不是合同成立的必备要件，合同是否成立与定金的交付没有关系。【法律依据】: 《中华人民共和国担保法》及其最高法院司法解释没有对证约定金作出专门规定，但是司法实践认可交付定金的书面证明为主合同业已经成立的证据。事实上，证约定金是一般定金都具有的共性，大多数情况下，定金的证约性质不因当事人专门约定而产生和独立存在，而是由违约定金、解约定金和成约定金所派生。
