释义	律师解答：分手费不算敲诈，因为分手费一般是不具有法律效力的，如果双方自愿就分手费达成一致协议，给付分手费的一方自愿给付的，是不违法的，不算是敲诈，除非是另一方以骗取分手费为目的，敲诈他人的，才是敲诈。【法律依据】：《中华人民共和国刑法》第二百七十四条敲诈勒索公私财物，数额较大或者多次敲诈勒索的，处三年以下有期徒刑、拘役或者管制，并处或者单处罚金；数额巨大或者有其他严重情节的，处三年以上十年以下有期徒刑，并处罚金；数额特别巨大或者有其他特别严重情节的，处十年以上有期徒刑，并处罚金。
