释义	被宣告死亡婚姻关系不是解除，而是消除。解除婚姻关系是指当事人办理离婚登记，或起诉离婚后，终止婚姻关系的过程。且一般不可以恢复。而婚姻关系消除是指被宣告死亡的人，与配偶的婚姻关系自死亡宣告之日起消灭。死亡宣告被撤销的，婚姻关系自撤销死亡宣告之日起自行恢复，法律依据：《中华人民共和国民法典》第五十一条被宣告死亡的人的婚姻关系，自死亡宣告之日起消除。死亡宣告被撤销的，婚姻关系自撤销死亡宣告之日起自行恢复。但是，其配偶再婚或者向婚姻登记机关书面声明不愿意恢复的除外。
