释义	代位继承是本位继承的对称。又称“间接继承”。被继承人的子女先于被继承人死亡或被宣告死亡，被继承人的子女的晚辈直系血亲代替被继承人子女的继承顺序，继承被继承人子女的应继承的遗产份额的制度。在代位继承中，死亡的继承人是被代位人。代替被代位人行使继承权的是代位人。代位人代替被代位人继承被继承人遗产的权利，称代位继承权。法律依据《民法典》第一千一百二十八条
