股东可以担任法定代表人，也可以不担任。但是股东可以有多个，法定代表人只有一个。公司法定代表人可以不是公司股东。

《中华人民共和国公司法》 第一百零四条 本法和公司章程规定公司转让、受让重大资产或者对外提供担保等事项必须经股东大会作出决议的，董事会应当及时召集股东大会会议，由股东大会就上述事项进行表决。
