释义	房屋买卖无效的租赁合同效力是属于合法房屋的租赁有效。房屋买卖合同无效的原因是房屋产权不合法，如违章建筑、超期的临时建筑、无证小产权房以及其他限制交易的房屋，没有任何合法手续的非法建筑物不得出租，但对于历史遗留的合法小产权房可以进行出租。【法律依据】《商品房屋租赁管理办法》第六条有下列情形之一的房屋不得出租：（一）属于违法建筑的；（二）不符合安全、防灾等工程建设强制性标准的；（三）违反规定改变房屋使用性质的；（四）法律、法规规定禁止出租的其他情形。
