释义	法律分析：精神病鉴定不计入羁押期，也就是不计入办案期限的。犯罪嫌疑人、被告人在押的案件，除对犯罪嫌疑人、被告人的精神病鉴定时间不计入办案期限外，其他鉴定时间都应当计入办案期限。对于因鉴定时间较长，办案期限届满仍不能终结的案件，自期限届满之日起，应当对被羁押的犯罪嫌疑人、被告人变更强制措施，改为取保候审或者监视居住。法律依据：《中华人民共和国刑事诉讼法》第一百四十九条对犯罪嫌疑人作精神病鉴定的期间不计入办案期限。
