法律分析:正式员工提前30天以书面形式通知单位,试用期提前3天。劳动者按此规定辞职是合法的,并不需要用人单位批准,时间一到可以离职。其中,试用期提前3天书面提出;用人单位有义务给劳动者结清工资并且办理离职手续。
法律依据:《中华人民共和国劳动合同法》 第三十七条 劳动者提前三十日以书面形式通知用人单位,可以解除劳动合同。劳动者在试用期内提前三日通知用人单位,可以解除劳动合同。
