释义	【法律意见】发生交通事故，交警队出具事故认定书后，交警队的责任就已经终结。事故双方可以就赔偿问题进行协商处理。伤者是否出院，需要根据其实际伤情来确定，如果伤情严重，应该继续住院治疗。如果已经没有必要继续治疗的，就应该出院。否则挂床的费用对方不承担赔偿责任。【法律依据】道路交通事故处理办法第三十九条交通事故的伤者和残者需要住院、转院、护理的，应当有医院证明，并经公安机关同意。擅自住院、转院、使用护理人员、自购药品或者超过医院通知的出院日期拒不出院的，其费用由伤者和残者承担。
