释义	法律分析：银行规定有五种人不可成为担保人：夫妻双方之间不可以互相担保；贷款地以外的户籍的人士不能作为担保；没有经济来源的不能担保；离休人员不能作为担保；国家明确规定不可以成为担保人的人。民法规定的不能成为担保的人只有三种：机关法人，除特殊批准除外；以公益为目的的非盈利法人；非法人组织。法律依据：《中华人民共和国民法典》第六百八十三条机关法人不得为保证人，但是经国务院批准为使用外国政府或者国际经济组织贷款进行转贷的除外。以公益为目的的非营利法人、非法人组织不得为保证人。
