提前退租押金怎样处理

可以主张退还，但需要一定赔偿。双方当事人之间签订租赁合同时对房屋的租赁期限应当是明确的，属于租赁合同的必备条款，承租人提前退租，解除租赁合同属于违约行为，应当承担相应的违约责任。对于承租人多交付的租金，当然是可以主张退还的，但是出租人也有权基于承租人提前解除租赁合同而主张违约损害赔偿。

《中华人民共和国民法典》 第五百七十七条 当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
