释义	法律分析: 在过错责任原则中，不仅要考虑行为人的过错，往往也会考虑受害人的过错或者第三人的过错。如果受害人或者第三人对损害的发生也存在过错的话，则要根据过错程度来分担损失，因此可能减轻甚至抵消行为人承担的责任。法律依据: 《中华人民共和国民法典》第一千一百六十五条行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
