国家军人一等功的待遇有：现役军人死亡，根据其死亡性质和死亡时的月工资标准，由县级人民政府民政部门发给其遗属一次性抚恤金，获得荣誉称号或者立功的烈士，其遗属在应当享受的一次性抚恤金的基础上，由县级人民政府民政部门按照下列比例增发一次性抚恤金：立一等功的，增发百分之二十五；中国人民解放军奖章分为英雄模范奖章和立功奖章两类，由总政治部统一制作。英雄模范奖章分一级、二级两种；立功奖章分一、二、三等功奖章三种。

第八十三条
对获得三等功、二等功、一等功奖励的个人，分别授予三等功、二等功、一等功奖章，并颁授证书。对获得三等功、二等功、一等功奖励的单位颁发奖状。荣誉称号由中央军委决定，中央军委主席向个人颁授英模奖章和证书、向单位颁授奖旗。一般在每年建军节前夕举行颁授仪式，也可以视情及时授予。荣誉称号的名称，根据授予对象的事迹特点确定。八一勋章由中央军委决定，中央军委主席签发证书并颁授，一般每五年授予一次。中央军委政治工作部可以根据实际情况，规定具体的奖励比例，其中对担任团级以上领导职务的军官（文职干部）的奖励应当从严控制。
