试用期三个月是什么？意思 |

三个月的试用期是指包括在三个月劳动合同期限内，用人单位对劳动者是否合格进行考核，劳动者对用人单位是否符合自己要求也进行考核的期限。
三个月试用期的设置基本上都是合法的。劳动法规定劳动合同签一年试用期不超过1个月、2年不超过2个月、3年不超过6个月，但凡设置为三个月的劳动合同会签3年，企业没有必要去签订1年试用期三个，即违法又没有实际好处。从风险性上来讲，一般人比较介意试用期太长，主要还是因为试用期内一般薪资打八折，时间长了本身相当于收入大打折扣，比如试用期六个月的。所以现在一般企业不设置6个月试用期，因为那样太难招到人了，即便是6个月也考虑薪资不打折，而三个月其实还是能接受的。
综上所述，对于企业而言试用期三个月可以足够观察员工是否能胜任工作、人品如何、态度如何，员工在这个企业也足以观察企业是否靠谱，双向选择三个月足够了。

劳动合同期限三个月以上不满一年的，试用期不得超过一个月；劳动合同期限一年以上不满三年的，试用期不得超过二个月；三年以上固定期限和无固定期限的劳动合同，试用期不得超过六个月。同一用人单位与同一劳动者只能约定一次试用期。以完成一定工作任务为期限的劳动合同或者劳动合同期限不满三个月的，不得约定试用期。
