释义	法律分析：不追究刑事责任：是因为立案后经侦察后确认没有犯罪事实，或者犯罪情节显著轻微不需要追究刑事责任，或者具有其他依法不追究刑事责任情形的，案件就此终结。免于处罚：是有刑事犯罪的发生，但因其他法定情形，如行为人不满14周岁或不满16周岁等，作出的一种处理结果。法律依据：《中华人民共和国刑法》第二十条正当防卫明显超过必要限度造成重大损害的，应当负刑事责任，但是应当减轻或者免除处罚。第二十一条紧急避险超过必要限度造成不应有的损害的，应当负刑事责任，但是应当减轻或者免除处罚。
