释义	法律分析：根据民事诉讼法的规定，在二审中达成调解协议，二审法院出具民事调解书后，原一审判决自然无效，也就等于没有作出过一审判决，因为一审判决在上诉后就一直没有生效。法律依据：《中华人民共和国民事诉讼法》第一百七十二条第二审人民法院审理上诉案件，可以进行调解。调解达成协议，应当制作调解书，由审判人员、书记员署名，加盖人民法院印章。调解书送达后，原审人民法院的判决即视为撤销。第一百七十三条第二审人民法院判决宣告前，上诉人申请撤回上诉的，是否准许，由第二审人民法院裁定。
