释义	法律分析：我国的民法典规定，通常情况下，孩子的姥姥和姥爷对孩子是有抚养权的。但是姥姥和姥爷的抚养权是有生效条件的，那就是孩子的父母双方已经去世，或者父母双方无法抚养该孩子。如果孩子的父母尚且有一方还没去世，并且愿意抚养该孩子，那么孩子的姥姥和姥爷就没有办法获得孩子的抚养权。法律依据：《中华人民共和国民法典》第一千零七十四条有负担能力的祖父母、外祖父母，对于父母已经死亡或者父母无力抚养的未成年孙子女、外孙子女，有抚养的义务。
