释义	法律分析：协议书有效，但没有离婚。离婚当事人在起诉前签订的离婚协议书是未生效的，虽不能直接作为法院判决当事人离婚的依据，但可以作为夫妻感情确已破裂的证据。夫妻关系要得到解除，需要法院的离婚判决(调解)或者到民政部门申请离婚领取离婚证。法律依据：《中华人民共和国民法典》第一千零七十六条夫妻双方自愿离婚的，应当签订书面离婚协议，并亲自到婚姻登记机关申请离婚登记。离婚协议应当载明双方自愿离婚的意思表示和对子女抚养、财产以及债务处理等事项协商一致的意见。
