释义	法律分析：醉酒的证人证言不能作为定案的依据。一般证人证言只能作为辅助证据，不能作为直接证据予以采信，需要和其他证据形成完整的证据链条。法律依据：《关于办理死刑案件审查判断证据若干问题的规定》第十二条以暴力、威胁等非法手段取得的证人证言，不能作为定案的根据。处于明显醉酒、麻醉品中毒或者精神药物麻醉状态，以致不能正确表达的证人所提供的证言，不能作为定案的根据。证人的猜测性、评论性、推断性的证言，不能作为证据使用，但根据一般生活经验判断符合事实的除外。
