无证驾驶发生交通事故责任怎么划分 |

无证驾驶是指机动车驾驶人在驾驶证准驾不符和驾驶证过期没更换相对应的合法准驾证明的情况下驾驶该机动车。
无证驾驶并不必然引起交通事故，关键看无证驾驶方在事故中的作用，所以无证驾驶与交通事故责任认定结果没有必然的关系，最重要的还是交通事故责任认定。
无证驾驶事故责任的划分是：
(一)因一方当事人的过错导致交通事故的，承担全部责任；当事人逃逸，造成现场变动、证据灭失，公安机关交通管理部门无法查证交通事故事实的，逃逸的当事人承担全部责任；
当事人故意破坏、伪造现场、毁灭证据的，承担全部责任；
(二)因两方或者两方以上当事人的过错发生交通事故的，根据其行为对事故发生的作用以及过错的严重程度，分别承担主要责任、同等责任和次要责任；
(三)各方均无导致交通事故的过错，属于交通意外事故的，各方均无责任;一方当事人故意造成交通事故的，他方无责任。
法律依据：根据《道路交通安全法》规定，
