承诺书与合同有冲突怎么办

法律分析：合同和承诺书相矛盾时是无效的。但是法律另有规定或者当事人另有约定的除外。法律规定了采用要约和承诺这种方式进行订立合同的，要求承诺生效时合同才会成立，当承诺和合同矛盾时说明合同无效未成立。
法律依据：《中华人民共和国民法典》
第四百七十九条 承诺是受要约人同意要约的意思表示。
第四百八十三条 承诺生效时合同成立，但是法律另有规定或者当事人另有约定的除外。
