一般情况下劫持船只罪立罪标准是什么

中国对劫持船只罪既遂量刑标准为五年以上十年以下有期徒刑、十年以上有期徒刑或无期徒刑，造成严重后果的，法定的量刑也更重。该罪主要是指行为人故意以暴力、胁迫或其他发放劫持船只的情形。
【法律依据】
《中华人民共和国刑法》第十四条
明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。
故意犯罪，应当负刑事责任。
第一百二十二条
以暴力、胁迫或者其他方法劫持船只、汽车的，处五年以上十年以下有期徒刑；造成严重后果的，处十年以上有期徒刑或者无期徒刑。
