税务行政规章可以设定的行政处罚如下：
1、罚款：是对违反税收法律、法规，不履行法定义务的当事人的一种经济上的处罚。由于罚款既不影响被处罚人的人身自由及其合法活动，又能起到对违法行为的惩戒作用。因而是税务行政处罚中应用最广的一种。因此，运用这一处罚形式必须依法行使，严格遵循法律、法规规定的数额、幅度、权限、程序及形式；
2、没收违法所得：没收违法所得是对行政管理相对一方当事人的财产权予以剥夺的处罚。具体有两种情况：
（1）对相对人非法所得的财物的没收。就性质而言，这些财物并非相对人所有，而是被其非法占有；
（2）财物虽系相对人所有，但因其用于非法活动而被没收。
3、停止出口退税权：停止出口退税权是停止出口退税权是税务机关对有骗税或其他税务违法行为的出口企业停止其一定时间的出口退税权利的处罚形式。
法律依据：《中华人民共和国行政处罚法》第十二条
国务院部、委员会制定的规章可以在法律、行政法规规定的给予行政处罚的行为、种类和幅度的范围内作出具体规定。尚未制定法律、行政法规的，前款规定的国务院部、委员会制定的规章对违反行政管理秩序的行为，可以设定警告或者一定数量罚款的行政处罚。
