释义	依据2004年1月1日起施行的《工伤保险条例》（国务院令第375号）第三十一条规定，职工因工作遭受事故伤害或者患职业病需要暂停工作接受工伤医疗的，在停工留薪期内，原工资福利待遇不变，由所在单位按月支付。工伤职工在停工留薪期内,用人单位每月支付给工伤职工的工资，如果劳动合同有明确约定工资数额的，以劳动合同约定的工资为准；如果劳动合同没有明确约定工资数额的，或者合同约定不明确时，以原实际支付的平均工资为准。
