法律分析：可以，但是有条件。基本条件如下：男职工60岁事管理和科研工作的女干部55岁，女职工50岁。基本养老金由基础养老金和个人账户养老金组成，职工达到法定退休年龄且个人缴费满15年的。若缴纳满15年，可以不交，反之要缴纳。参加基本养老保险的个人，达到法定退休年龄时累计缴费不足15年的，可以缴费至满15年，按月领取基本养老金可以领取一次性养老保险待遇。但如此规定着的草案依旧维持了缴费15年的基本门槛。新的参统单位(指各类企业)单位缴费费率确定为10%，个人缴费费率确定为8%，个体工商户及其雇工，灵活就业人员及以个人形式参保的其他各类人员，根据缴费年限实行的是差别费率。参加基本养老保险的个人劳动者，缴费基数在规定范围内可高可低，多交多受益。职工按月领取养老金必须是达到法定退休年龄，并且已经办理退休手续在单位和个人依法参加了养老保险并履行了养老保险的缴费义务人缴费至少满15年。
法律依据：《国务院关于开展新型农村社会养老保险试点的指导意见》 第七条 年满60周岁、未享受城镇职工基本养老保险待遇的农村有户籍的老年人，可以按月领取养老金。
