释义	法律分析: 出轨是指已婚者与配偶之外的人发生恋情。出轨从字面上它是一场恋爱，但从实质上它不过是一个偷情、偷性的过程。法律上主要规定了三种夫妻不忠行为，即：通奸、同居、重婚。出轨如果构成重婚或者与他人同居的，配偶可以要求离婚损害赔偿。法律依据: 《中华人民共和国民法典》第一千零九十一条有下列情形之一,导致离婚的,无过错方有权请求损害赔偿: (一)重婚; (二)与他人同居; (三)实施家庭暴力; (四)虐待、遗弃家庭成员; (五)有其他重大过错。
