释义	劳动合同到期，如果没有续约，劳动者是否可以向用人单位主张经济补偿，要根据具体情况而定。根据《中华人民共和国劳动合同法》第四十六条第五款规定，除用人单位维持或者提高劳动合同约定条件续订劳动合同，劳动者不同意续订的情形外，依照本法第四十四条第一项规定终止固定期限劳动合同的，劳动者可以主张经济补偿。第四十四条第一项规定是劳动合同期满的，劳动合同终止。反过来说，只有用人单位降低待遇或其他条件，劳动者不同意续订的才可以主张补偿。
