释义	法律主观：关于强奸罪的成立，以明知妇女是不能正确表达自己意志的精神病人或有严重痴呆的人而与之性交的人，不管犯罪分子采取什么手段和被害妇女是否表示“同意”或“反抗”，都应视为违背妇女意志，构成强奸罪；对患有间歇性精神病妇女在精神病没有发作期间同意与之发生性交行为的，不构成强奸罪；对确实不知道妇女是青春型精神病患者，在妇女的勾引下与之发生性交行为的，一般不宜以强奸罪论处；对确实不知道妇女患有较轻微的痴呆症，在女方自愿或者在女方主动要求下与之发生性交行为的，不宜以犯罪论处。
