释义	法律分析: 法律对于违约金没有具体要求，仅要求不超过损失的30%。但是在协议中约定违约金为合同金额的5%也不违反法律。一旦涉诉，参照具体损失，如果超过损失的30%，超过部分法院不予支持而已。法律依据: 《中华人民共和国民法典》第一百八十六条因当事人一方的违约行为，损害对方人身权益、财产权益的，受损害方有权选择请求其承担违约责任或者侵权责任。
