释义	法律分析: 不移诉不逮捕，一般人民检察院不能审查起诉。因为只有公安机关侦查终结后，将起诉意见书，连同案卷材料、证据一并移送给同级人民检察院，检察院才能审查决定是否提起公诉。法律依据:《《中华人民共和国刑事诉讼法》》第一百六十三条在侦查过程中，发现不应对犯罪嫌疑人追究刑事责任的，应当撤销案件；犯罪嫌疑人已被逮捕的，应当立即释放，发给释放证明，并且通知原批准逮捕的人民检察院。
