释义	律师解答：缔约能力是指依国际法规定，及承担违约责任的能力。国家和其他国际法主体都有这种能力。不过，除国家外，其他国际法主体的缔约能力之范围是有局限性的。缔约权，也就是缔约的代表权，即代表国家或其他国际法主体缔结条约的权力。没有这样地位的国家机关或其他国际法主体的机关是不能代表国家或其他国际法主体缔结条约的。【法律依据】：《维也纳条约法公约》第六条国家缔结条约之能力每一国家皆有缔结条约之能力。
