释义	法律分析：有无遗嘱、有限责任公司还是股份有限公司、公司章程有无特别规定。股东去世后，在有数个继承人共同继承时，如果公司章程未就股权继承作出特别规定，则被继承的股权只能由享有继承权的数个继承人作为共同共有人的一个整体，共同行使该股权，而不能直接以股东身份向公司主张股权。全体继承人因行使所继承股权而获得的利益和风险，均由各继承人共同享有和共同承担。法律依据：《中华人民共和国公司法》第七十五条自然人股东死亡后，其合法继承人可以继承股东资格；但是，公司章程另有规定的除外。
