释义	法律分析: 没有办理商品房预售登记的商品房预售合同转让比较简单。开发商、买受人、受让人协商一致后，解除买受人与开发商原先签订的预售合同，再由新的受让人与开发商另签一份商品房买卖合同即可，不须经过房屋主管部门的批准和履行预售商品房转让程序。法律依据: 《中华人民共和国城市房地产管理法》第四十五条商品房预售的，商品房预购人将购买的未竣工的预售商品房再行转让的问题，由国务院规定。而国务院没有出台具体规定，从该法看预售房是可以再转让的，而实际上预售商品房的转让是合同的转让。
