传染病故意传播罪
释义
法律主观：
故意传播传染病罪，明知自己患有梅毒、淋病等严重性病卖淫、嫖娼的，处五年以下有期徒刑、拘役或者管制，并处罚金。本罪在主观方面表现为故意，即行为人明知自己患有严重性病，而出于某种动机或为达到某种目的，仍然向他人卖淫或嫖娼。
法律客观：
《刑法》第三百六十条明知自己患有梅毒、淋病等严重性病卖淫、嫖娼的，处五年以下有期徒刑、拘役或者管制，并处罚金。第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
