释义	法律分析: 刑法对于强奸罪的对象仅仅限定在女性，并未将强行与男性发生性关系进行法律规范。根据法无规定不为罪的原则，“强奸”男性行为并不构成犯罪，当然也不构成强奸罪。假如行为人把男的误认为妇女而着手实行强奸，并且完成“强奸行为”，并不构成强奸罪，可能会涉嫌构成强制猥亵罪。法律依据: 《中华人民共和国刑法》第二百三十七条以暴力、胁迫或者其他方法强制猥亵他人或者侮辱妇女的，处五年以下有期徒刑或者拘役。聚众或者在公共场所当众犯前款罪的，或者有其他恶劣情节的，处五年以上有期徒刑。
