释义	法律分析：新要约是受约人在接到要约通知以后向要约人发出的新的提议或建议。受约人表示对原要约的条款作某些变更为条件订立合同，这种变更条件的意思表示即受约人向原要约人发出的新要约。此外，受要约人对要约拒绝后，在承诺期限内又表示同意接受要约，也为新要约。受要约人在承诺期限后才表示承诺的，不为承诺，而为新要约。法律依据：《民法典》第四百八十六条，受要约人超过承诺期限发出承诺，或者在承诺期限内发出承诺，按照通常情形不能及时到达要约人的，为新要约；但是，要约人及时通知受要约人该承诺有效的除外。
