释义	《合同法》427条规定，居间人未促成合同成立的，不得要求支付报酬，只能要求委托人支付从事居间活动支出的必要费用，如实际发生的交通费、通信费等。中介公司单方面以格式条款约定委托人在买卖不成的情况下承担所谓中介服务费或违约金，不具有法律效力。如果买卖双方利用了中介的交易信息或依靠其媒介作用达成了交易却不支付居间费用，则应承担相应违约责任。
