释义	法律分析：合同的混同是什混同，是指债权和债务同归一人，致使合同关系消灭的事实。债权人和债务人系立于对立状态，法律乃在于规范此类对立的主体之间的财产关系，债权因混同而消灭，并非逻辑的必然，仅仅是在通常情况下，处于这种状态下的债权继续存续，已经没有法律上的需要，法律规定它因混同而消灭，效果更佳。债权系他人权利的标的时，从保护第三人的合法权益出发，债权不消灭。法律依据：《民法典》第五百七十六条，债权和债务同归于一人的，债权债务终止，但是损害第三人利益的除外。
