释义	1.反诉只能由被告向原告提起，其他诉讼参与人之间不发生反诉的关系。2.反诉必须向受理本诉的法院提起，否则就可能是起诉而不是反诉。3.反诉必须在法院受理本诉后至法庭辩论终结前提出，之前或之后都不是反诉。4.反诉的请求和事实理由与本诉具有牵连性，存在着法律上的联系，否则就要另行起诉，也不能合并审理。法律依据：《中华人民共和民事诉讼法》第五十一条原告可以放弃或者变更诉讼请求，被告可以承认或者反驳诉讼请求，有权提起反诉。
